Failure to produce the MANDATORY required documents, at least (7) seven days before the Meeting of Creditors, will result in rescheduling the Meeting of Creditors to a new date and time.

Failure to produce the MANDATORY required documents, at least (7) seven days, prior to the 2nd listing, will result in the filing of a Trustee’s Motion to Dismiss

Mandatory Documents:

1. Pay Advices Filed Directly to the Courtdue 14 days after filing of the petition unless otherwise extended by Court Order (60 days pre-petition stubs or Affidavit of No Pay Advices [Word][PDF])

Debtor’s Counsel should note:

11 U.S. Code § 521 – Debtor’s duties:

….(a)(1)(B)(iv) copies of all payment advices or other evidence of payment received within 60 days before the date of the filing of the petition, by the debtor from any employer of the debtor;

And

….(i)(1) Subject to paragraphs (2) and (4) and notwithstanding section 707(a), if an individual debtor in a voluntary case under chapter 7 or 13 fails to file all of the information required under subsection (a)(1) within 45 days after the date of the filing of the petition, the case shall be automatically dismissed effective on the 46th day after the date of the filing of the petition.

2. Most recent year’s Federal Income Tax return along with all schedules or tax transcript (or Affidavit of No Returns) 11 U.S. Code § 521(e)(1)(2)(A)(i)

3. Declaration Regarding Administration of Oath & Confirmation of Identity & SSN

4. Self-Employed/Business Cases (In addition to the above):
Completed Business Package
2 Years Tax Returns

Failure to produce additional documents, within (14) fourteen days after the Meeting of Creditors, may result in the filing of an Objection to Confirmation and/or a Trustee’s Motion to Dismiss
